This privacy policy statement informs how the Bergen International Festival (hereafter "FiB", "Festival", "we" or "us") collects and uses personal data about people who give or receive an Art Gift or who visit our website.

1. Responsibility for the processing of personal data at FiB
The Bergen International Festival, under the Chief Executive and Artistic Director, is the data controller of the company's processing of personal data. The data controller has the responsibility that the treatment of personal data is in accordance with current General Data Protection Regulation (GDPR).

2. Overview over the processing of personal data
2.1 The giver of an Art Gift
FiB collects and processes necessary personal data about the giver of an Art Gift to register the order and carry out the event. We treat personal data including name, phone number, e-mail address, and information regarding special concerns that the artist should be aware of, in the cases where this is stated.
We also tread information about why you wish to give the gift to the receiver. The purpose is to give the artist information about the relation between the giver and receiver, and the background for the gift, so that the artist can use this information when the gift is introduced. The information will also be used by the Festival’s moderator of the Art Gifts, in order to consider whether the gift should be given or rejected.
2.2 The receiver of an Art Gift
FiB treats necessary personal data about the receiver of an Art Gift in order to carry out the event. We treat personal data including name, address, preferred language, the reason for the giver to give the gift, and information regarding special concerns that the artist should be aware of, in the cases where this is stated.
The personal data is treated in order to carry out an agreement, cf. GDPR article 6 number 1 b), and to maintain our legitimate interest in considering if the gift should be given or rejected, cf. GDPR article 6 number 1 f). The personal data will be deleted three weeks after the event is completed.
2.3 Audience survey
FiB sends out an audience survey by e-mail to participants at our events. The purpose is to collect statistics that give us insight into our audience and their opinions about the Festival.
When you participate in the survey, we will treat data about country of residence, age, income level, profession, number of previous visits at the Festival, and other personal data that is stated in answers in the survey.
We also collect the following categories of information by using tracking technology:
- Information about use: e.g. visitor logs, including IP address, cookies, etc.
- Information about the unit used: e.g. the kind of web browser that is used, and which operating system is used
- Information about the source of referral: which source or website that referred you to the survey
- Information that is collected via page code data (gif files, web beacons, web bugs): e.g. to se the number of people who has answered different questions, and what the replies were
You can also voluntarily leave your e-mail address to participate in the draw of a prize. This draw is performed approx. three weeks after the end of the Festival, and your e-mail will be deleted after this.
The personal data is treated on the basis of your consent given when you registered as a participant in the survey, cf. GDPR article 6 number 1 a). It is completely voluntary to participate, and you can at any time withdraw your consent. If you withdraw your consent, then we will stop the treatment of information and delete the information we have stored about you.
2.4 Visit at the website
When you visit the website artgift.fib.no, cookies are placed in your browser. Cookies are small text files that are stored on your computer, mobile phone or tablet when the website is downloaded in your browser.
By visiting our website, you consent to cookies in your browser, since most browsers accept cookies automatically. You can reject the use of cookies by changing the settings in your browser.
Google Analytics
FiB gathers statistics about how the website is used through the analysis tool Google Analytics. The purpose of the statistics are to improve the information offered on the website.
The statistics give an overview of:
- How many pages are being visited
- How many are visiting our pages
- The duration of the visit
- Which kind of browsers are being used
- Which kind of units are being used (desktop, tablet or phone)
- IP adresses to show the geographic location of the visit
The information is sent to Google and stored in the company's servers in the USA. Google can transfer the statistics to third parties if required by law or in cases where third parties process information on behalf of Google.
The personal data is processed in order to maintain our legitimate interest in improving the information offered on our websites, cf. GDPR article 6 number 1 f). The statistics are deleted after 26 months.
Overview of cookies on the website:
- _ga og _gid: First-party cookies from Google Analytics that generate a unique ID that is used in order to collect statistics about how you use the website. _ga is deleted when the website is closed and _gid is deleted after a day.
- Gatsby-intl-language: First-party cookie used to show the website in different languages. The cookie is deleted after 2 years.
- Gift: First-party cookie containing all information added to the form and is used to contain this information while the booking is being performed. The cookie is deleted when the website is closed.
3. Disclosure of personal data
FiB does not give personal data to other parties unless we have gathered consent from you, or there is another legal basis to transfer the information.
We use providers of IT services to treat personal data on our behalf, so called data processors. We have entered into a data processing agreement with the providers that secures that the personal data is treated in accordance with the GDPR and our instructions.
In some cases, the IT providers can transfer and store personal data on servers or subcontractors in countries outside the EU/EEA area (third party countries). In order to secure that the personal data is treated in properly in the receiving country, the transfer will only happen in cases where there is a valid basis for transfer. Overview of receivers and data processors:
- Artists: receives personal data necessary to carry out the event in accordance with the order.
- Clicksend: SMS sending service used in connection with an order and cancellation of an event. The information is treated in Australia. The basis of transfer is EU’s standard agreement.
- Mailchimp: E-mail sending service used in connection with an order and cancellation of an event. The information is treated in the USA. The basis of transfer is EU’s standard agreement.
- Alchemer: Service for sending and conducting audience surveys. The information is treated in the USA. The basis of transfer is EU’s standard agreement.
- Google Analytics: Generate statistics about website visitors. The information is treated in the USA. The basis of transfer is EU’s standard agreement.
4. Storage time and deletion
FiB does not store personal data longer than is necessary to fulfill the purpose of the treatment. Our regular deadlines for deletion can be found in part 2 of this statement.
You may in some cases ask that your personal data is deleted before our regular deletion deadlines expire, cf. part 5 below. However, we inform you that we cannot delete information that is necessary for compliance with a legal obligation which requires processing, or if there is a dispute and the information is necessary for the establishment, excercise or defence of legal claims.
5. Rights
When businesses treat personal data about you, you have the right to be informed about the treatment. FiB complies with the duty to provide information in this privacy statement and will as a main rule refer to this statement when asked to provide information.

In some situations, you are entitled to object to our processing of information about you.

If the treatment of personal data happens with the basis of consent or an agreement with you, you may ask us to transfer the information about you to you or to another controller.
How to exercise your rights
You may exercise your rights by sending an e-mail to info@fib.no. We will reply as soon as possible, and within 30 days at the latest.
If necessary, we will ask you to provide identification or other information in order to confirm your identity before we can fulfill your rights.
6. Complaints
You have the right to complain to The Norwegian Data Protection Authority if you feel that we do not comply to Personal Information Act. You can find more information about how to complain at The Norwegian Data Protection Authority’s website. We do hope that you will let us know first, so that we may have the opportunity to rectify the situation. Complaints can be sent to info@fib.no.
7. Changes to the privacy policy statement
We will update this privacy policy statement when necessary, and you will always find the latest version on our website. If there are major changes in the collection and treatment of personal data, or changes that require renewed consent from you, we will alert you about this.
